Changing the Locks Is the Landlord Breaking the Law

Some landlords get impatient and try to force a tenant out without going to court — changing the locks, cutting the power or water, or hauling belongings to the curb. In California that is called self-help eviction, and it is illegal. Ava asked attorney Michael Benavides what a tenant can do.

Ava: Can my landlord ever lock me out without a court order?

Michael, Esq.: No. Even if you're behind on rent, even if your lease ended, the only lawful way to remove you is the court eviction process. Locking you out on their own is illegal self-help eviction.

Ava: What exactly is off-limits?

Michael, Esq.: Under Civil Code section 789.3, a landlord can't shut off or interfere with your utilities — water, heat, light, gas, electricity, phone — to make you leave. They also can't change the locks, remove outside doors or windows, or take your personal property from the unit.

Ava: What if they already did it?

Michael, Esq.: The law puts a price on it. A landlord who violates section 789.3 is liable for your actual damages plus a penalty of up to $100 for each day the violation continues, with a minimum of $250 per separate violation — and the court can award your attorney's fees.

Ava: Can I get back in?

Michael, Esq.: Yes. A court can order the landlord to restore your possession and your utilities. Because a lockout is an emergency, courts can act quickly.

Ava: What should I do the moment it happens?

Michael, Esq.: Document everything — photos of the changed lock or dark unit, the date and time, any texts or notes from the landlord, and names of witnesses. Then get help fast. The daily penalty and your damages build a strong demand.

Ava: Is a shutoff for ‘repairs’ different?

Michael, Esq.: It can be, if it's genuinely necessary and temporary. But using a ‘repair’ as cover to make life unlivable so you'll leave is still illegal. Intent and effect matter.

Ava: Can this turn into money for me?

Michael, Esq.: Frequently. Between the per-day penalty, actual damages, possible punitive damages, and attorney's fees, an illegal lockout often exposes the landlord to far more than the rent they were chasing.

What to Do

If your landlord changed the locks, shut off your utilities, or removed your doors to push you out, that's illegal self-help eviction under Civil Code section 789.3 — worth up to $100 a day plus your damages and attorney's fees, and a court can order you back in.
